외국 NCP(국가별 연락사무소)의 운영 쟁점과 동향
본 연구에는 OECD 다국적기업 가이드라인 이행에 필요한 각국 NCP(국가별 연락사무소)가 마련하고 있는 주요 절차의 내용과 다국적기업의 의미, 그리고 구 체적으로 제기된 이의제기사건 처리 과정에서 최종성명서에 기술되는 OECD 다 국적기업 가이드라인 이행과 관련한 구체적 권고 내용이나 이해관계 당사자들 간의 협력적 비협력 행위에 대한 평가, 그리고 가이드라인 위반 여부에 대한 기 술 방식 등에 대해 살펴보았다. 그 결과 의미있는 기술방식들이 확인되었으나 매우 다양한 기술방식들을 보여주고 있다는 것을 확인하였다. 그리고 다양한 기 술방식들은 각국 NCP가 처한 환경과 여건에 의존되는 것으로 볼 수 있다. 국내 NCP도 국내 이해관계당사자들의 대화나 협력 환경과 여건 등을 고려하 는 NCP 활동 정책이 필요하다. 이 연구가 확인한 각국 NCP의 다양한 기술방식 들과 검토는 국내 NCP가 OECD 다국적기업 가이드라인을 증진시키는 데 이바 지 할 수 있는데 상당한 기여를 할 수 있다고 본다. 또한 2023년 OECD 다국적기업 가이드라인이 개정됨에 따라, NCP의 역할이 강화되게 되었다. 그리고 개정 OECD 가이드라인에서 판정 및 권고 관련하여 NCP가 이의신청 사건과 관련하여 판단을 내릴 수 있는 근거가 마련되었고, 또 한 후속조치 관련하여 권고가 후속조치와 결합될 수 있게 되었다. 이와 같이 개 정된 OECD 다국적기업 가이드라인의 내용을 바탕으로, 각국 NCP의 절차규정 에도 추후 개정 등이 변화가 예상되는 바 향후 NCP의 역할 강화를 기대해볼 수 있을 것이다.
Trends in the Activity of National Contact Points and Their Implications
The current study examines the procedures that each National Contact Point (NCP) has set up for the implementation of the Organisation for Economic Co-operation and Development (OECD) Guidelines for Multinational Enterprises on Responsible Business Conduct (“the Guidelines”), the definition of multinational enterprises, and specific recommendations related to the implementation of the Guidelines that have been put forward in the process of resolving specific instances and included in the final statements, the assessment of cooperative and non-cooperative actions of stakeholders, and the different ways by which cases of non-observance of the Guidelines are described. The study found a few relevant ways of describing non-observance, and also noted that there were diverse ways to do so. The findings indicate that the ways of describing non-observance of the Guidelines differ depending on the circumstances and resources of each NCP. For the Korean NCP, there is a need for policy measures facilitating the NCP activity, taking into account communication among stakeholders in Korea, the policy environment, and resources. The diverse ways the NCPs describe non-observance of the Guidelines and the related analysis found in the current study would significantly help the Korean NCP contribute to enhancing the Guidelines. Moreover, the amendment of the Guidelines in 2023 has strengthened the role of NCPs in the sense that the amended Guidelines provides for the NCPs to resolve specific instances. Furthermore, follow-up and recommendations are now allowed to be handled jointly. Thus, with the amended Guidelines, it is expected that the rules and procedures of the NCPs could be amended as well, leading to the enhancement of the role of the NCPs in the future.
