독일법상 입양 시의 동의에 관한 고찰

우리 민법이 부부공동입양주의(제874조)를 취하고 있는 관계로 부부 중 일방 이 입양을 희망하는 경우에 타방은 이에 대해 동의해야 한다. 나아가 13세 미만 인 미성년 아동의 경우에는 법정대리인이 입양을 대낙하고, 13세 이상의 미성년 인 아동의 경우에는 법정대리인의 동의를 얻어 스스로 승낙을 하며(제869조), 양 자가 될 자녀가 성년인 경우에는 특별한 경우를 제외하고는 부모의 동의를 얻어 야 한다(제871조). 또한 양자가 될 사람이 혼인을 한 경우에는 배우자의 동의를 얻어야 한다(제874조). 이렇듯 여러 경우에 동의나 승낙의 의사표시를 필요로 하 고 있음에도 불구하고 우리 민법에는 그 절차나 방식 등에 관해 규정이 마련되 어 있지 않다. 반면에 독일 민법은 양자가 될 아동의 친부모의 동의, 양자가 될 아동의 동의, 양부모가 될 사람의 배우자의 동의로 나누어 비교적 상세히 규율하고 있다. 물 론 우리 민법도 미성년자 입양에 대한 부모의 동의(제870조)와 성년자 입양에 대한 부모의 동의(제871조) 및 양자가 될 사람이 배우자가 있는 경우에 그 배우 자의 동의(제874조 제2항), 친양자입양의 경우 친생부모의 동의 및 법정대리인의 동의(제908조의2 제1항 제3호・제4호・제5호)로 나누어 규정하고 있다. 그렇지만 독일민법에 규정된 혼외자의 아버지의 동의, 그리고 동의의 내용 및 방식이나 특히 동의가 실효되는 경우 등에 관해서는 별도의 규정을 두고 있지 않다. 그래 서 실제 어떤 방식으로 동의권자에 대해 동의를 얻고 있는지 불분명하고, 무엇 보다 입양될 아동의 복리가 중요시 되는 입양결정에서 아동과 친부모의 의사는 매우 중요한데, 그 동의의 절차와 방식에 관한 규정이 독일법에 비애 미비할 정 도록 너무 간단하다. 그래서 입양에 대한 동의에 관해 상세한 규정을 두고 있는 독일법을 개관함으 로써 우리 민법의 단점을 보완할 수 있는 시사를 얻고자 한다.

Consent to Adoption in German Civil Law

German civil law regulates in relatively detail by dividing it into the consent of the biological parents of the child to be adopted, the consent of the child to be adopted, and the consent of the spouse of the person to be adopted. Of course, the Korean Civil Law also stipulates the consent of parents for adoption of minors (Article 870), the consent of parents for adoption of adults (Article 871), the consent of spouses (Article 874 (2)), and the consent of biological parents and legal representatives (Article 908-2 (1) 4, 5). However, there are no separate regulations on the content and method of consent, or in particular, when the consent is invalidated. Even if adoption is essential for the welfare of a child, the child's right to self-determination to be adopted should be respected, and even if it is a child under the age of 13 prescribed by the Civil Law, the child's will(or wish) must be heard. This is because when considering the welfare of a child, the child's will should be the first priority.
