결혼이민여성의 공공부조 수급권에 관한 소고

본 연구의 목적은 한국의 공공부조 관련 법률에서 결혼이민여성의 수급권 인 정 여부를 포괄적으로 검토하고, 이를 바탕으로 결혼이민여성의 공공부조 수급 권 문제를 개선하기 위한 정책적 시사점을 도출하는 데 있다. 검토 결과 일반적 공공부조에 해당하는 국민기초생활보장법과 긴급복지지원법에서는 외국인 특례 조항을 통해 결혼이민여성에 대한 수급권을 예외적으로 인정한다. 이때, 혼인 관 계 외에도 추가적인 요건을 충족하는 경우에만 수급 자격을 부여한다. 반면 범 주적 공공부조인 기초연금법과 장애인연금법에는 적용 대상이 국민으로 한정되 고, 수급권에 관한 외국인 특례조항조차 별도로 존재하지 않는다. 다만, 기초연 금과 장애인연금에서도 관계 법령에 따라 외국인이더라도 매우 예외적으로 수급 권이 인정되는 경우가 있다. 이러한 입법정책은 결혼이민여성 간의 차별을 야기 하고, 수급권이 미성년 자녀나 배우자의 직계존속에 대한 돌봄 의무를 이행하는 동안 한시적으로만 인정되는 문제가 있다. 혼인 기간 가정에서 결혼이민여성이 수행한 사회적 의미와 기여 정도를 고려하면, 적어도 돌봄 의무를 이행한 결혼 이민여성과 사별한 결혼이민여성, 한국인 배우자의 유책 사유로 인해 별거 중이 거나 이혼한 결혼이민여성 등을 중심으로 공공부조 수급권을 단계적으로 확대할 필요가 있다.

A Study on the Beneficiary Right of Female Immigrants through Marriage in Public Assistance

This study aims to comprehensively examine whether female immigrants through marriage are entitled to beneficiaries in public assistance and to draw policy implications from the findings in order to improve the problems. Key findings from the study are as follows. The National Basic Livelihood Security Act and the Emergency and Aid Support Act, both of which are general public assistance, grant exceptionally the right to receive benefits for female immigrants through marriage by special provisions for foreigners. In this case, the entitlement is granted only if additional requirements are met in addition to the marital relationship. On the other hand, the Basic Senior Pension Act and the Pension Act for Persons with Disabilities, which are categorical public assistance, are only applicable to the public with citizenship, and there is no special provision for foreigners regarding the beneficiary right. The benefits are indirectly provided when the entitlements are granted for foreigners in other related laws. This legislative policy might provoke significant discrimination among female immigrants through marriage and even the entitlement is only temporarily acknowledged while fulfilling the duty to care for the elderly and the children. Therefore, considering their social contributions, at least the right to receive public assistance needs to be gradually expanded, focusing on female immigrants both who have fulfilled their care obligations and who are separated or divorced due to widowhood or a cause attributable to their spouses.
