통상임금 재산정에 따른 추가 법정수당 청구의 신의칙 위반 여부 — 판례의 분석을 중심으로 —

지난 2021. 12. 16. 현대중공업 사건에서 대법원은 노사관행에 따라 통상임금 에서 제외되었던 정기상여금을 추후 통상임금에 포함하여 재산정한 추가 법정수 당의 청구가 신의칙에 위배되지 않는다는 판결을 내렸다. 주지하듯이 대법원은 통상임금 관련 분쟁의 획을 그었던 2013. 12. 18. 갑을오 토텍 사건 전원합의체 판결에서 근로자가 정기상여금을 통상임금에서 제외하기 로 한 노사합의의 무효를 주장하며 정기상여금을 통상임금에 포함하여 재산정한 추가 법정수당을 청구하는 것이 신의칙에 위배된다고 판단한 바 있다. 갑을오토텍 사건 이후 하급심 판례만 지속적으로 나왔을 뿐 대법원 판례의 공 백이 크던 중 2019. 2. 14. 시영운수 사건에서 오랜만에 추가 법정수당 청구의 신의칙 위반 여부가 논란이 되었다. 이 사건에서 대법원은 추가 법정수당 청구 가 사용자에게 중대한 경영상의 어려움을 초래하거나 기업의 존립을 위태롭게 하여 신의칙에 위반되는지는 신중하고 엄격하게 판단하여야 한다고 함으로써 대 법원 판례로서는 처음으로 추가 법정수당 청구의 신의칙 위반을 부정하였다. 이 판결 이후 대부분의 판례는 추가 법정수당의 신의칙 위반 여부를 매우 신 중하고 엄격한 기준으로 판단해야 한다는 입장으로 선회하여 신의칙 위반을 부 정하였고, 소수의 판례만이 신의칙 위반을 긍정하였다. 현대중공업 사건은 이러한 판례 기조의 연장선에 있다고 할 수 있다. 이 사건 에서 대법원은 기존 판례의 입장에서 한 걸음 더 나아가 기업이 일시적으로 경 영상의 어려움에 처하더라도 사용자가 합리적이고 객관적으로 경영 예측을 하였 다면 그러한 경영상태의 악화를 충분히 예견할 수 있었고 향후 경영상의 어려움 을 극복할 가능성이 있는 경우에는 신의칙을 들어 근로자의 추가 법정수당 청구 를 쉽게 배척해서는 안 된다고 하고 있다. 이 기준에 의하자면 사실심 종결 당시 기업이 경영상 어려움에 처한 경우라 할지라도 기업이 이러한 경영악화를 예 견할 수 있었고 향후 이를 극복할 가능성이 있는 경우에는 추가 법정수당의 청 구가 신의칙 위반으로 간주될 수 없게 된다. 그러나 기업 환경이 시시각각으로 변하는 요즈음 사실심 종결 이후 기업의 계속성이나 수익성, 경영상 어려움 또 는 이를 극복할 가능성이 있는지를 예견할 수는 없다. 기업을 운영하는 데는 예 측하지 못한 변수가 시시각각으로 발생할 수 있기 때문이다. 문제는 기업이 중대한 경영상 어려움에 처하게 되었거나 존립이 위태로운 상 황에서 추가 법정수당을 지급할 경우 회생불능의 상태로 이어질 수도 있고, 이 는 종국적으로 근로자 측에까지 피해가 미치게 되어 노사 어느 쪽에도 도움이 되지 않는 결과를 초래할 수 있다는 점이다. 또다른 문제는 각 판례가 신의칙 위반 여부를 판단할 때 특정 수당의 정기상 여금성, 추가 법정수당 청구의 소멸시효, 대상근로자, 대상기간, 경영상 어려움의 판단 시점 등 각기 다른 기준을 그 근거로 삼아 추가 법정수당 청구의 신의칙 위반을 부정하고 있다는 것이다. 이러한 불규칙한 판단기준은 대법원 판례의 신 뢰를 떨어뜨릴 뿐만 아니라 법적 안정성을 심각하게 훼손한다. 어떠한 이유로든 비슷한 시기 비슷한 조건하에 발생한 다툼에 대하여 판결시점에 따라 판단기준 을 달리하며 추가 법정수당 청구의 신의칙 위반을 인정 또는 배척하는 것은 금반언의 원칙에 반한다.

Violation of the Principle of Good Faith in the Claim for Additional Statutory Allowances due to the Realignment of Ordinary Wages — Focusing on the Analysis of Precedents —

After the 2013 A-B Autotech case, the Supreme Court precedents related to the principle of good faith in additional legal allowances following the realignment of ordinary wages began to pour out from the 2019 municipal transportation case. The period of labor-management agreement in these cases is usually almost the same as the period of labor-management agreement in the A-B Autotech case. Nevertheless, in the case of A-B Autotech, the claim for additional legal allowances was regarded as a violation of the principle of good faith, while the absolute majority of rulings after the municipal transportation case denied the violation of the principle of good faith. The Hyundai Heavy Industries case of 2021 further strengthens the criteria for judging violations of the good faith principle, and takes a position that even if the management status of the company deteriorates at the end of the fact-finding trial, the violation of the good faith principle cannot be recognized if the possibility of overcoming is predicted. As in the logic of Hyundai Heavy Industries’ precedent, if the request for a claim depends solely on the management situation of a company at the time of the fact-finding trial, the legitimate claim of workers can be denied by accidental court judgment. On the other hand, paying additional legal allowances in a situation where a company is in serious management difficulties or its existence is in jeopardy may lead to an inability to revive, which may ultimately damage the workers, resulting in no help to both labor and management. Another problem is that the precedent after the municipal transportation case denies the violation of the good faith principle based on different criteria such as the regular bonus of a specific allowance, the extinctive prescription of an additional legal allowance claim, the target worker, the target period, and the timing of management difficulties. These irregular criteria not only undermine the trust of Supreme Court precedents, but also seriously undermine legal stability. For any reason, it is contrary to the principle of estoppel to recognize or reject violations of the principle of good faith in additional statutory allowance claims, with different criteria for disputes arising under similar conditions at the same time. Therefore, if the Supreme Court considers justice and equity, it should pay attention to the basic principles related to the good faith principle of the A-B Autotech case, but judge the request for additional statutory allowance on a consistent basis.
