소규모 사업장의 안전보건 실태와 대응 방안

그동안 50인 미만 그 중에서도 5인 미만 사업장이 가장 안전사고의 위험이 높 고, 실제로 사망자 발생 빈도가 높다는 것은 모든 사람이 알고 있는 사실이다. 하지만, 이러한 현상이 개선되기 보다는 계속 악화되고 있다는 점이다. 다시 말 해, 산업현장의 안전과 보건의 상황은 빈익빈 부익부 현상이 더욱 심해지고 있 다는 점을 지적하지 않을 수 없다. 정부에서는 OECD 회원국 37개 중에서 산업재해를 당하여 사망하는 근로자 비율이 매우 높아 선진국 수준으로 낮추기 위해 안전・보건조치를 제대로 이행하 지 않은 사업주에게 보다 강한 처벌이 가능하도록 관련 법령을 제・개정해 왔다. 산업안전보건법(이하 ‘산안법’)이 제정된 이래 40차례 이상 개정되면서 처벌 수 준은 꾸준히 상향되어 왔다. 특히, 지난 2018년 젊은 청년(김용균씨)의 사망사고 를 계기로 전부개정까지 하게 되었다. 2021년 1월 26일에는 처벌이 한층 강화된 중대재해 처벌 등에 관한 법률(이하 ‘중대재해처벌법’)이 제정되었다. 하지만, 강한 처벌규정은 수규자가 처벌을 피할 수 있는 가장 손쉬운 방법을 찾게 만드는 부작용도 간과해서는 안된다. 그 결과는 안전과 보건 상황이 열악 한 소규모 사업장은 더욱 취약해질 개연성은 높아질 수도 있다. 또한 사업주들 은 법의 적용을 덜 받는 규모로 상시근로자수를 축소하거나 회사를 분사하는 등 의 편법도 마다하지 않을 수도 있기 때문이다. 최근 산업재해나 사업장 및 근로자수 변동 추세를 보면 법의 적용을 덜 받거 나 제외되는 50인 미만 사업장수와 근로자수가 모두 증가하고 있다는 사실을 주 목해야 한다. 50인 미만 사업장에서 2020년 사망자수의 81%, 사망자가 발생한 사업장 점유율도 80.3% 차지한다는 점이다. 향후, 국내 젊은 사람들은 영세한 소규모 사업장이나 건설현장에 취업하는 것 을 기피하는 결과로, 상대적으로 산업재해를 당하기 쉬운 외국인이나 고령자들 의 열악한 사업장 취업 비중은 증가할 것이다. 따라서 취약한 근로자들을 실효 적으로 보호할 수 있는 제도개선과 국가적 차원에서 지원할 수 있는 방안을 마련하는 등 다각적 대응이 요구된다. 마지막으로, 이제는 원청이 도급이나 위탁 등의 계약 방법을 통한 ‘위험의 외 주화’는 근절되어야 하고, 사업장을 지배・관리하는 도급업체의 역할도 중요하지 만 국가적 차원에서 제한된 인적・물적 자원을 가장 효율적으로 집행할 수 있는 방안을 찾는 것도 시급한 과제라 하겠다.

Safety and Health Status of Small Businesses and Countermeasures

19) We all know that workplaces with fewer than 50 employees have the highest risk of safety accidents and, in fact, have the highest number of fatalities. However, this phenomenon continues to worsen rather than improve. In other words, it point outs that the situation of safety and health at industrial sites is getting worse and worse. The government has enacted and amended related laws to enable stronger punishment for employers who fail to properly implement safety and health measures in order to lower the proportion of workers who die from industrial accidents among 37 OECD member countries to the level of advanced countries. Since the Occupational Safety and Health Act was enacted, it has been revised more than 40 times, and the level of punishment has been steadily increased. In particular, in the wake of the death of a young man in 2018, the entire revision was made. On January 26, 2021, the ‘Serious Disaster Punishment Act’ was enacted. But, the side effect of strong punishment should not be overlooked, which makes business owners look for the easiest way to avoid punishment. As a result, small businesses with poor safety and health conditions may be more likely to become more vulnerable. In addition, business owners will not avoid from expedients such as reducing the number of full-time workers to a scale that is less subject to the law or dividing the company. Looking at the recent trends in industrial accidents and changes in the number of workplaces and workers, it should be noted that both the number of workplaces with less than 50 employees and the number of workers, which are less or excluded from the law, are increasing. It is that workplaces with fewer than 50 employees will account for 81% of the number of deaths in 2020, and the share of workplaces with fatalities will also account for 80.3%. In the future, as a result of young people in Korea avoiding working in small-scale workplaces or construction sites, the proportion of foreigners and elderly people who are relatively prone to industrial accidents will increase in these workplaces. Therefore, a three-dimensional response is required, such as improving the system to effectively protect vulnerable workers and devising a way to support them at the national level. Lastly, the ‘outsourcing of risk’ through contract methods such as subcontracting or consignment by the primary agency should be eradicated. Finding a way to implement it is also an important task.
