아동학대의 신고 및 개입과 그 책임에 관한 소고 - 미국의 민사적 아동보호시스템에 관한 판례와 제정법을 중심으로 -
최근에 국내에서 아동학대사건이 많이 발생하고 있다. 매스컴에서는 부모의 학 대나 방임으로 인하여 아동이 사망하는 사건이 연일 보도되고 있다. 과연 최근에 서야 아동학대사건이 빈발하게 된 것일까? 아동을 부모의 소유물로 여기는 관념 이 우리나라의 법률에서 뿐만 아니라 왜곡된 유교적 윤리에 따라 일반 사회에 팽 배해 있지는 않은가? 필자는 이러한 의문을 가져보았다. 이러한 의문에 해답을 찾고자 미국의 민사적 아동보호시스템을 살펴보았다. 무 엇보다도 예방과 초기대응이 중요한 아동학대 및 방임에 관해서는 공적 개입이 필요하다. 그러나 학대와 방임 사건 모두는 공적 개입의 적절성에 분명한 경계를 요구한다. 미국에서도 헌법적 그리고 실정법적인 이론 외에서, 가족생활에 개입할지 여부, 그리고 아동을 격리할지 여부에 관한 결정은 더욱 어려워 보인다. 왜냐하면 격리 된 아동은 주가 제공하는 종종 비참하고 부적절한 돌봄을 받기 때문이다. 아동기 와 청소년기 전체를 통하여 신체적 또는 정서적 지원이 거의 제공되지 않거나 최 소한의 서비스만을 제공하는 장기간의 가정위탁에 두는 것도 아동의 최선의 복리 에 해당하지 않는다고 하는 것이 일반적이다. 미국에서도 아동학대 및 방임과 같 은 아편 같은 위기는 아동보호를 위한 다양한 대응책을 개발하고 있는 주정부에 대해서 뿐만 아니라 아동보호기관에 대해서도 많은 이의를 제기하고 있다. 그러나 신고와 조사, 공적 개입의 기소면제와 같은 법률이나 법원의 태도는 아 동학대사건에 있어서 예방적이고 사전적 조치가 가장 중요하다는 점에서는 우리 법에 시사하는 바가 크다.
Reporting Law of Child Abuse, and Public Intervening and the Liability — Focusing on the Civil Child Protection System in U.S. —
In U.S., there are three major systems regulate families affected by abuse or neglect; Criminal Law, Welfare System, and the Civil Child Protection System. The author focused on the Civil Child Protection System in this article. So, the author first reviewed the case law regarding the superiority of parental right than the children’s right( ). Since the Blackstone era, the notion that children are nothing more than the property of their parents has persisted. In modern times, with the emphasis on “the best interest of the child”, the protection of children against child abuse and neglect has begun to be talked about in the population. However, there are limits to the intervention of state’s authorities to protect children from child abuse and neglect. Due to the protection of the family under the Constitution, there must be a legal basis for the intervention of public institutions( ). Of course, in the case of wrongful intervention, authority or social worker may bear tort liability( ). Above all, in child abuse cases where preventive measures or prompt measures at an early stage are most appropriate, the civil child protection system of the United States will play a significant role.
