예술인의 산업안전과 재해보상
예술인복지법 제7조에 근거하여 예술인의 업무상 재해에 대한 보호가 가능해졌고 그 방식은 산업재해보상보험법이 정한 바에 따르게 되었다. 예술인의 예술활동에 대 해 산재보험의 적용가능성을 모색하고 결국 적용방안을 강구하게 된 것은 예술인의 예술 활동과 결부된 위험성이 높고 사고발생시 예술인의 인적, 물적 손해를 보상할 필요성이 있기 때문이다. 당해 논문에서는 근로자 산재보험제도과 예술인 산재보험제도를 상호 비교, 대조 하는 방식을 통해서 향후 예술인 산재보험제도가 실질적 재해보험으로 기능할 수 있는 방안을 강구한다. 예술인 산재보험제도가 갖고 있는 근본적이고 본질적인 문제 점을 중심으로 살펴보고자 한다. 첫째, 사전적 예방과 사후적 구제의 유기적이고 완결된 체계로 전환할 필요가 있 다. 산업안전보건법을 적용할 수 없다면 이에 상응하는 실질적이며 효과적인 사전적 예방책을 별도로 마련할 수는 없는지 고민해 볼 필요가 있다. 한국예술인복지재단과 다양한 직군별 예술인협회나 단체와의 협응을 통한 방안의 강구가 필요하다. 둘째, 예술인과 예술활동의 특수성을 고려하며 실질적인 산재보험방안이 강구되어 야 한다. 이를 위해서는 예술인의 다양한 실태와 예술 활동의 실제가 산재보험제도 운영과 산재승인 과정에 반영되어야 하는데, 한국예술인복지재단과 근로복지공단의 협력적 노력이 절실히 요청된다. 셋째, 근본적인 해결책은 특히 산재보험 적용 및 산재승인 기관에서 유권적이고 독자적인 예술인 산재보험의 ‘업무상’의 해석기준을 제시하는 것일 것이고, 단기적인 해결책은 예술인 산재보험상의 사고에 대해 분류와 유형화를 통해 전형적 산재사고 와 그 승인의 사례를 제시하는 것이다.
Occupational Safety and Accident Compensation for Artists
Artists Welfare Act Article 1 says “The purpose of this Act is to legally protect the professional status and rights of artists; to promote the creative activities of artists; and to contribute to artistic development by providing artists with welfare support services.” And Artists Welfare Act Article 7(1) says “The Industrial Accident Compensation Insurance Act shall apply to accidents effecting artists in the course of engaging in the arts, to compensation for them, etc.” According to Artists Welfare Act Article 7(1), Artists have the right to take up the industrial accident compensation insurance that is one of social insurances if they choose to. Nevertheless there are lots of improvements to make in application of Industrial Accident Compensation Insurance Act to artists. First, because the main purpose of Industrial Safety and Health Act is preventing industrial accidents and diseases of workers, we have to devise a method for applying this act to artists. Where is this not possible, we should suggest an alternative. Preventing industrial accidents and diseases of artists is as important as compensating rapidly and fairly. Secondly, we should examine and check whether current Industrial Accident Compensation Insurance Act is appropriate to artists. Industrial accidents and diseases of artists are unusual and uncommon in comparison with workers’. Thirdly, we should establish the standard of interpreting the concept ‘industrial accidents and diseases’ for artist and artistic activities.
