유엔 아동권리협약 제3선택 의정서 가입 및 이행을 위한 독일의 법제대응

유엔 아동권리협약은 전 세계 아동권리의 헌장으로 독일은 제3선택의정서 가입이후 정치적, 법적 부분에 많은 변화를 꾀하고 있다. 먼저 독일에서 아동은 독립적인 권리주체로서 아동의 권리 역시 헌법상 기본권으로서 규정, 이를 통해 아동의 권리를 보장하기 위한 적극적인 움직임을 보이고 있다. 많은 주와 지방자치단체에서 아동과 청소년의 참여권에 대한 다양한 규정들을 구비했으나 이러한 참여권은 각주의 상황에 따라 달리 규정되어있는 상태이다. 독일 전체에 적용되는 헌법으로 독일의 법적, 정치적 기본질서를 담고 있는 최상위 법인 독일기본법은 제3선택의정서에 의한 개정이 논의되었다. 독일 기본법 제6조는 혼인, 가족, 자녀교육에 관한 다양한 보장들을 포괄하고 있는데 제6a조의 신설을 통해 아동권리협약의 기본원칙인 보호, 지원, 분배, 협력, 차별금지, 아동복지의 우선 등의 기본이념을 바탕으로 법적 지위의 개선을 위해 아동뿐 아니라 부모의 아동 교육책임에 대해 국가 공동체가 지원하는 내용을 논의 중에 있다. 아동은 자신에게 영향을 미치는 문제에 개입할 권리가 있고, 아동의 참여권 보장은 부모의 의무이며 국가의 의무로 규정, 아동의 의견표명권은 국가가 돌보는 아동뿐만 아니라 모든 국가기관의 일반적인 집행의 대상으로서 모든 아동들에게도 인정되어야 한다. 아동이익 최우선의 가치는 아동의 권리와 이익과 관련된 독일 국내법에 의해 결정된다고 규정하여 아동권리와 관련된 법률과 체계가 자리 잡혀 가는 상태이다. 그러나 우리나라의 아동권리와 관련된 법체계는 필요에 따라 제정, 개정되다보니 통일적이고 효율적인 체계성을 확보하지 못하고 있는 실정이다. 이에 대한 보완을 강구할 필요가 있다.

A Study on the Response of German Legislation to Join and Implement the Optional Protocol to the Convention on the Rights of the Child to Provide a Communications Procedure

The U.N. Convention on the Rights of the Child is the charter of children's rights around the world. Germany has made many changes in political and legal aspects since joining the Optional Protocol to the Convention on the Rights of the Child to Provide a Communications Procedure. As a change, the German Constitution Law has been actively moving to guarantee children's rights through it, including stipulating that children's rights are not only independent rights entities but also basic rights under the Constitution. Many states and local governments in Germany have various regulations on the right to participate in children and adolescents, but these rights are defined differently depending on the circumstances of each state. The German constitution Law, a top-tier corporation that contains Germany's legal and political basic order under a constitution that applies to Germany as a whole, discussed revisions under the Optional Protocol to the Convention on the Rights of the Child to Provide a Communications Procedure. Article 6 of the German Constitution Law covers various guarantees on marriage, family and children's education, and the establishment of Article 6a is under discussion by the state community on the responsibility of children's education as well as their parents to improve their legal status based on the basic principles of the Convention on the Rights of the Child: protection, support, distribution, cooperation, prohibition of discrimination and priority of child welfare. Children have the right to intervene in matters affecting them, and the guarantee of children's right to participate is the duty of parents and the state, and the right to express their opinions shall be recognized by all children, as well as by children taken care of by the state, as the subject of general enforcement of all state organs. The priority value of children's interests is determined by German domestic laws related to children's rights and interests, and laws and systems related to children's rights are in place. However, the legal system related to children's rights in Korea has been enacted and revised as necessary, and thus has not secured a unified and efficient system. It is necessary to seek supplementary measures.
