고용형태와 신분제 형성문제에 대한 소고 - 무기계약직을 중심으로 -

최근 정부가 시행한 비정규직의 정규직 전환과정에서 무기계약직에 대한 문제점이 불거지고 있다. 비정규직을 보호하기 위해 정규직으로 전환하는 과정에서 무기계약직을 무분별하게 도입하다보니 정규직과의 차별을 해소하기에는 미흡한 실정이다. 이러한 차별적 처우를 바로잡기 위해 무기계약직이 근로기준법 제6조의 사회적 신분에 해당한다는 주장이 제기되고 있다. 다만 이를 인정하더라도 현재는 차별을 발생시킨 원인을 해소하지는 못하고 결과측면에서 이를 교정할 가능성만 존재하는 상황이다. 따라서 무기계약직이 근로기준법 제6조의 사회적 신분에 해당함을 증명해내지 못하거나 고용환경 변화로 새로운 고용형태가 나타날 경우에는 이러한 차별을 해소하기는 더욱 어려워질 것이다. 이에 무기계약직과 같은 고용형태가 무엇을 근거로 하는지 살펴볼 필요가 있다. 그것이 경영권 내지 경영사항에서 비롯된다면, 경영사항이 사업장 내에서 신분제를 창설할 정도의 권리근거가 되는 것인지 살펴보아야 한다. 만일 경영사항이 권리근거가 될 수 없다면 고용형태에서 비롯된 차별처우를 결과측면에서 다투기 전에 차별을 정당화하는 고용형태를 무분별하게 만들지 못하도록 제한할 수 있을 것이기에 이를 고찰해 보고자 하였다.

Recently, problems have arisen over “unlimited contract workers” in the government-initiated transition of fixed-term workers to full-time workers. it is not enough to address discrimination against full-time workers by recklessly introducing “unlimited contract workers” in the process of switching to regular ones to protect non-regular workers. to correct this discrimination, it has been argued that “unlimited contract workers” constitutes the social status of Article 6 of the Labor Standards Act. however, even admitting this does not solve the cause of discrimination and only correct it in terms of results. therefore, it will be difficult to address discrimination if “unlimited contract workers” fail to prove their social status under Article 6 of the Labor Standards Act, or if a new employment pattern appears due to changes in the employment environment. therefore, it is necessary to look at what employment patterns such as “unlimited contract workers” are based on. if is originates from management, it should be looked at whether management is the basis for the right to create an identity system within the workplace. if management cannot be a basis for rights, the Act considered that discrimination resulting from employment patterns could be restricted from creating employment types that justify discirimination before competing in terms of results.
