청년 과도기 노동의 헌법적 의미

이 논문은 청년 과도기 노동의 헌법적 의미를 고민해 보고자 한다. 청년 문제 의 실마리는 청년 노동 문제 해결에서 찾을 수 있으며, 헌법적 근거에 입각할 때 이 문제에 대한 적절한 대응 방안을 모색할 수 있기 때문이다. 먼저 이 논문 은 노동 문제를 다룬다는 전제 아래에 논의 대상이 되는 청년을 학교-고용 이행 기에 속한 인구집단으로 개념 범위를 구체화하고자 한다. 그리고 이 집단에서 전형적으로 발견되는 노동 형태인 청년 과도기 노동을 일경험을 위해 노동을 제 공하는 활동으로 개념화하였다. 청년 과도기 노동은 특성상 교육과 노동의 이중 적 성격을 갖는다. 따라서 청년 과도기 노동자 역시 학습자이자 노동자로 이중 적 지위를 가진다. 하지만 임금 노동자 아니면 비노동자라는 이분법에 근거하고 있는 현행 법체계는 청년 과도기 노동자 보호와 교육 기능 활성화와 관련하여 일정한 한계를 보여주고 있다. 본 논문은 노동권과 교육권은 공정 노동권을 매 개로 하여 서로 연결될 수 있다는 점에 주목한다. 청년 과도기 노동자는 임금 노동 여부와 관계없이 종속 노동을 수행하는 자이다. 따라서 헌법상 노동권의 보호 대상이다. 동시에 그들이 수행하는 노동은 직업 교육・훈련의 일부이기도 한다. 따라서 노동자이자 학습자로서 교육권이 보장되어야 한다. 청년 과도기 노 동을 무조건 부정적으로 보고 무리하게 기존 정규직 임금 노동 속에 편입시킬 것이 아니라 교육적 측면을 강화하고 부당한 노동 착취를 근절하는 방안을 모색 해야 한다. 입법자는 청년 과도기 노동을 규율하는 법률이 일경험이라는 목적 아래에 노동권과 교육권이 조화를 이루도록 해야 한다. 입법자는 교육 기능을 온전히 실현하기 위해 노동법 적용이 배제되는 특별 입법을 통해 노동관계를 규 율할 수 있다. 그러나 노동이 교육의 실질을 갖추지 못한 노동은 일반적인 임금 노동으로 보아야 하며, 따라서 임금 노동자에 적용되는 기준과 동일하게 기본권 제한 여부를 따져 물어야 한다. 이때 교육의 실질 판단과 관련해서는 교육 기본권 실현 정도가 하나의 기준으로 고려될 수 있다.

Constitutional Meaning of Youth Transitional Labour

This research attempts to illuminate the constitutional meaning of youth transitional labour. Many youth-relevant issues are tightly related to youth employment. In addition, appropriate youth policies could be formulated in the context of constitutional law. Before going into the substantial parts, the research conceptualises the youth being targeted as a population group in the school-employment transition period. And the youth transitional labour as an employment mode typically found in this group is conceptualised as practices where workers serve the employers mainly for job training. Youth transitional labour has a dual nature of education and labour. Therefore, youth transitional workers also have dual status as learners and workers. However, the current legal system based on the dichotomy of wage workers and non-workers shows several flaws in protecting young transitional workers and revitalising educational functions. This research argues that the right to fair labour can be interpreted as extending to the right to education. A youth transitional worker is a person who performs subordinate labour regardless of whether or not they work for wages. Therefore, it is subject to the protection of labour rights under the Constitution. At the same time, the work they perform is also part of vocational education and training. Therefore, as workers and learners, the right to education must be guaranteed. This approach does not view youth transitional labour as unfavourable labour practices that should be integrated into regular wage labour. Instead, the paper proposes a new way to strengthen the educational aspect and eradicate unfair labour exploitation. Legislators should ensure that laws governing youth transitional work pursue the protection of both labour and education rights under the objective of work experience. To fully achieve the educational goal of transitional youth labour, legislators can regulate employment relations by establishing special legislation separated from the application of labour laws. However, if the essence of education cannot be found in certain labour activities, those activities cat not be considered transitional youth labour anymore. As a result, this kind of labour should be regarded as regular wage labour, the constitutionality of which should be reviewed according to usual standards. In this case, the degree of realisation of a basic right to education can be considered a criterion for judging the substance of education.
