신자유주의 시대 구조적 폭력의 한 양상 - 2000년대 이후 노동법제의 변화와 노동기본권의 위기를 중심으로 -

오늘날 폭력의 개념은 전쟁 테러라는 물리적 폭력뿐만 아니라, 인간을 폭력에서 보호하기 위해 등장한 각종의 법, 제도들이 오히려 폭력의 근원으로 여겨지면서 구 조적 제도적 문화적 폭력으로까지 그 외연이 확대되었다. 국가의 폭력독점이 근대화 의 징표로 합법화되었으나 각종 사회제도와 문명화제도 자체의 폭력성, 특히 국가폭 력독점의 구체적 발현형태인 법의 폭력성, 법과 폭력의 착종성에 대한 사유는 ‘법으 로 위장된 폭력의 지배’의 본질을 보여주고 있다. 특히, 신자유주의 시대의 법은 신자유주의가 내장한 ‘구조적 폭력’을 유지 공고화 하는데 기여한다. 21세기적인 새로운 ‘폭력적 사회의 원인을 제공하는 법률’ 혹은 ‘구조적 폭력의 심화수단인 법률’의 한 사례로서 노동법은 2000년대 이후 신자유주 의 경제정책을 정립하는데 결정적 역할을 해왔다. 폭력개념의 지평을 확대한 갈퉁은 구조적 폭력을 생존, 복지, 자유, 정체성의 욕 구 등 인간의 기본적 욕구나 권리실현을 방해하는 것으로 본다. 그의 구조적 폭력개 념은 신자유주의 시대를 살아가는 인간의 삶에 강력하게 작동하는 권력(자본력)의 통치체계를 잘 설명해줄 수 있다. 푸코는 신자유주의의 시장이 경쟁의 장이며 국가가 경쟁의 지원과 장려를 주도하 고 있다고 보면서 신자유주의 시장의 인간은 자신의 능력을 효율적으로 생산해야 하는 인적자본으로서 “호모 에코노미쿠스”로 사유하고 행위한다고 보았다. 1993년 김영삼 정부의 세계화 담론으로 시작해서 1997년 외환위기 이후 한국의 노동시장에 서는 구조조정과 고용 유연화가 상시화되었고, 사회구성원들은 저비용 고효율을 내 세우는 기업의 경쟁논리는 내면화하며 자기자신을 관리 경영하는 호모 에코노미쿠스 로 재탄생하였다. 폭력과 법의 교착성은 국가폭력을 정당화, 합법화하는데 법률이 동원되는 극단적 사례인 ‘국가범죄’에서 잘 드러난다. 법치를 위장한 적나라한 국가폭력의 가능성뿐만 아니라, 노동법이 노동자 등 소수자의 권리를 축소시키고 기업 등 특정집단의 권리 를 우대한다면, 이것은 신자유주의의 구조적 폭력의 원인을 법이 제공하고 있는 것 이며, 법은 그 합법화된 기능에서 일탈된 국가폭력과의 경계를 상실하게 된다. 한국사회는 97년 외환위기 이후 상시적 구조조정으로 비정규 노동자가 폭발적으 로 증가하였으나, 오히려 노동법은 노동보호법제로서의 규범적 대처 능력을 상실하 였다. 친기업적 경제정책을 내세운 이명박 정부는 대대적 인원감축과 비정규직화를 수단으로 경쟁과 효율의 증대를 핵심으로 하는 노동시장 유연성 제고를 지속적으로 추진하였다. 박근혜 정부의 노동정책 또한 신자유주의 노동시장 유연화와 ‘노사관계 의 사법화’를 심화시켰다고 평가된다. 문재인 정부는 초기 친노동적 정책들을 적극 적으로 펼쳤으나, 정책추진과정에서의 종합적 기획력, 추진전략 및 실행력 미비로 후퇴 내지 선회하고 있다. 신자유주의 노동시장의 유연화는 곧 노동법의 유연화를 의미했으며 역대정부의 ‘노동선진화입법’ 혹은 ‘노동개혁법안’은 신자유주의적 경제체제 및 노동정책을 뒷받 침하는 주요 수단이 되었다. 노동법이 강자의 지배도구이자 약자의 권리배제수단으 로서 신자유주의의 구조적 폭력과의 경계를 상실하지 않기 위해서는 노동하는 인간 의 권리를 보호하는 본래의 자기 역할로 되돌아가야 한다.

An Aspect of Structural Violence in the Neoliberal Era – Focusing on the changes in labor legislation and the crisis of labor rights since the 2000s –

The concept of violence today has expanded not only to physical violence such as of war and terror, but also to structural, institutional, and cultural violence. The state's monopoly of violence has been legalized as a sign of modernization. But thinking on the violence of the various social systems and civilized institutions themselves that emerged to protect human beings from violence, especially the violent nature of the law which is a specific manifestation of national monopoly, and the mutual implication of law and violence, shows the nature of the “dominance of violence disguised as law”. In particular, the laws of the neoliberal era contribute to maintaining and consolidating of “structural violence” built-in neo-liberalism. As an example of the new 21st century ‘laws that provide causes of a violent society’ or ‘laws that is a means of deepening structural violence’, labor law has played a decisive role in establishing neoliberal economic policies since the 2000s. Galtong, who expanded the horizon of the concept of violence, sees structural violence as a hindrance to human basic needs or rights, such as survival, welfare, freedom, and desire of identity. His concept of structural violence can explain the governance system of power(capital power) that works strongly in human life in the neoliberal era. Foucault believes that the market of neo-liberalism is the arena of competition and that the state is driving the support and encouragement of competition. He saw that humans in the neoliberal market thought and acted as “Homo Economicus” as human capital that had to efficiently produce their abilities. Starting with the Kim Young-sam administration's discourse on globalization in 1993, since the 1997 financial crisis, restructuring and employment flexibilization in the Korean labor market has always been continued. In the process, members of society were reborn as Homo Economicus manages themselves by internalizing the competitive logic of companies that promote low cost and high efficiency The flexibilization of the neo-liberalistic labor market meant the flexibility of labor laws, and the previous governments’ ‘labor advancement legislation’ or ‘labor reform acts’ became a major means of supporting neo-liberal economic systems and labor policies. In order not to lose its boundary with structural violence in neo-liberalism as a dominant tool for the strong and a means of exclusion of rights for the weak, labor law must revert to its original role of protecting the rights of human beings who work.
