「산업안전보건법」상 감정노동자 보호제도의 실효성 강화 방안

「산업안전보건법」상 감정노동자를 보호하기 시작한 지 1년이 되었다. 현행 「산업안전보건법」은 감정노동자 보호와 관련하여, ‘고객응대근로자’의 개념을 확립하고 이들의 건강권 보호를 위해 고객의 폭언행위로 인한 사업주의 예방조치를 규정한다(법 제26조의2제1항). 고객응대근로자관련 보호입법은 제3자의 폭언등으로 인한 근로자에 대한 사업주의 「산업안전보건법」상 법적 의무를 부과하고, 근로자에 대한 법적 조치 요구권 등을 부여하는 등 제3자의 행위로 인한 근로자의 건강권 및 안전에 관한 권리를 법제화 하였다. 다만, 이러한 법적 규율에도 불구하고, 여전히 개별 조항에 따른 해석상 제기되는 문제와 비고객응대근로자에 대한 제3자의 행위에 대응할 수 있는 시스템 마련, 모든 노무제공자의 직무스트레스에 적극적으로 대응해 나갈 필요성 등은 지속적으로 풀어나가야 할 과제로 남는다. 이 연구에서는 「산업안전보건법」상 감정노동자 보호를 위한 관련 법제도의 검토와 평가를 통해 여전히 과제로 남을 수 있는 쟁점을 도출하고, 향후 법적 실효성을 높일 수 있는 방안을 모색한다.

Measures to Enhance Effectiveness of the Emotional Workers Protection System under the Occupational Safety and Health Act

It has been a year since the Occupational Safety and Health Act in Korea began to regulate the protection of emotional workers. The current Occupational Safety and Health Act establishes the concept of ‘customer-response workers’ in relation to the protection of emotional workers, and to protect the right to health of customer-response workers, prescribes for employers to take measures to prevent acts of verbal or other abuse by customers (Article 26-2 (1)). The protection legislation for customer-response workers is subject to the employer’s legal obligations under the Occupational Safety and Health Act, and the Act provides the right to health and safety of workers fringed by third parties’ verbal and/or other abuses. It is a very meaningful legislation that legislated the right to health and safety. In spite of these legal regulations, however, there is still a problem of interpretation according to the individual provisions, lack of a system to cope with the actions of third parties to non-customer responding workers, and the need to actively respond to the job stress of all workers. These problems have yet to be solved. In this study, through the review and evaluation of the relevant legal system for the protection of emotional workers under the Occupational Safety and Health Act in Korea, I explore issues surrounding these remaining tasks and ways to increase legal effectiveness.
